  • Israeli Fatalities

Although the mandate of the PHRMG formally only covers the human rights of Palestinians in the West Bank, the Gaza Strip and East Jerusalem, we have decided to add a section on Israeli casualties in the al-Aqsa Intifada to give a more complete picture of the situation. The data presented in this section has been collected by B'Tselem (www.btselem.org).

In addition, 12 Palestinian citizens of Israel were killed by the Israeli security forces inside Israel at the beginning of the al-Aqsa Intifada, and 1 Palestinian citizen of Israel was killed by Israeli security forces in the Old City of Jerusalem.

Notes and comments:

  • International law, which sets the criteria for legitimate use of force, admits the existence of a right to self-determination 25 and of self-defense 26 . Many respected legal commentators such as Richard Falk 27 also infer the existence of a positive right to resist the occupation. Such a right certainly exists when Israel conducts operations inside Palestinian-controlled areas.

  • However, under international humanitarian law, the distinction between civilians and combatants must be made at all times, and civilians must not become the target of armed operations. This rule applies obviously also to Palestinian operations against the Israeli occupation.

  • Children are civilians. Israeli children, whether living in settlements or inside Israel, must not be the targets of attacks. A child, according to the UN Convention on the Rights of the Child, is a person below the age of 18. The table above does not include a special section for children aged 15-18 since no allegation has been made that Israeli children have participated in combat operations. Children represent 17% of Israeli fatalities.

  • The fact that Israeli settlements in the Palestinian territories are illegal under international humanitarian law does not mean that settlers can be killed. Humanitarian law forbids the transfer of (Israeli) civilian population from (Israel) the occupying country to the occupied (Palestinian) lands, not the transfer of an occupying army, which is the essence of occupation. Considering all settlers as combatants would assimilate them to the occupying army, and would therefore legitimize their presence in the Palestinian territories.

  • The purely civilian status of the settler population, however, is not established either. Several factors blur the distinction:

  • Many adult male settlers are armed and sometimes initiate attacks on Palestinians.

  • Security patrols have also been organized around certain settlements, approved by the Israeli army but not submitted to any specific, openly acknowledged regulations.

  • Settlements are often protected by the Israeli army, and the presence of troops and tanks further undermines the civilian character of the settlements.

  • In some cases, because of their location and function, Israeli settlements must be considered security outposts rather than civilian dwellings.

  • Palestinians justify attacks inside Israel by the inequality of the confrontation with the Israeli army inside the Palestinian territories, and by the need to force the Israeli population to face the actions of the settlers and soldiers in the territories. However, beyond the questionable political and strategic wisdom of such actions, it is not clear whether Palestinian attacks inside Israel also fall under the legitimate right to resist the occupation.

  • Even the legitimacy of attacks against Israeli military personnel inside Israel is questionable, since Palestinian operations inside Israel were almost never targeting specifically Israeli military personnel, and civilians were also endangered and/or killed.

  • Attacks against Israeli civilians inside Israel must be condemned without reservation.
