 18. Recommendations

For the 6th consecutive year, the Palestinian Security Services continue to act arbitrarily in detaining Palestinian men and women, boys and old people, in violation of the law and ignoring the cries of mothers and children.

Confirming our goal to support the rule of the law, the PHRMG calls upon the Palestinian Authority:

1. To respect every citizens’ right to personal freedom and security every citizen’s right to be detained and brought before a court in accordance with legal procedures.

2. To consider opinions opposing the formal position of the Executive Authority as an act that does NOT threaten the national security. The right of the individual to fight for his national political honor and dignity is not an act of incitement.

3. To establish clear rules for the duties of every security service in the country and to develop the monitoring of administrative measures.

4. To halt its arbitrary arrests and security measures taken against civilians.

5. To abolish all detention centers that were not formed and that do not function in accordance with the law.

6. To strengthen the principle of the rule of the law in all PA security services and institutions.

7. To confirm that the General Prosecution must carry out its responsibilities to apprehend and question suspects and to confirm that the Attorney General must intervene to prevent any violations of relevant penal law and to secure the release of detainees whose procedural rights have been violated.

8. To respect and support the role of the Palestinian judicial system.

9. To support all legal and legislative institutions and all those who work for the national interest in taking a firm position against the deteriorating human rights situation and against the undermining of the rule of the law.

10. To adopt a courageous positive stand and to put an end to the practice of political arrest, to release all political detainees or to respect the law in guaranteeing them fail trials.

11. To improve conditions inside the Palestinian detention centers.
